Harris v. NCC BOD

The matter is set for trial 6/10/11 in Bay County Court. This is 3 years to the day since the matter was filed.

The Case continues against the Condo Assn.-

This suit is now into its 3rd year. The costs mount, this is a loser pays all case. As you will see from the below posts it is NOT a case that I will lose, so the Nautilus Cove Condo Association will end up paying for both their own costs and my costs.

FYI: Earlier this year settlements were again proposed by me, Alan O'Neal of Waterstone Resort Realty, LLC chose to settle the matter. The Condo Assn. through its BOD has not bothered to reply, so the suit continues.

Should the Condo have settled, my terms were:
1) A statement from them that the Condo documents regarding rentals of units would be adhered to.
2) Payment of my costs to date of $6,500.

The BOD continues to ignore the matter and shortly we will be going to the depositions and interrogatories phase which will increase costs by at least 200%. This will not be paid by the 3 knucklheads on the BOD but will end up with a special assessment of the 167 condos in order to pay my eventual costs.

For Your Information:

Rules & Regulations at 12.
Use Restrictions, 12.1 Residential Use. "The condominium units ... may be used for single-family residential living and for no other purpose."

Further at 14 Leasing of Units.
14.3 Occupancy During Lease Term. "No one but the lessee, and his family within the first degree of relationship by blood, adoption or marriage, and their guests may occupy the Unit"

And 14.4 Occupancy in Absense of Lessee. "If a lessee absents himself from the unit for any period of time during the lease term, his family already in residence may continue to occupy the unit. If the lessee and all of the family members mentioned in the foregoing sentence are absent, no other person may occupy the Unit."

There are other sections defining who 'guests' are (Marriott or labor contractor employees do not qualify) and how occupants of all rental units must register with the Manager before or at the time of occupancy (Marriott and labor contractor employees are not so registered).

2007-08 Photos for - 2008 Civil Suit

This is a seperate blog to hold information regarding the Waterstone Resort Realty and Nautilus Cove Assn. suit, (Case #08-2529-CA) which was filed by me, a NCC Condo owner (708) on June 10, 2008 in the 14th Judicial Circuit Court in Panama City.


The problem here was that foreign imported employees who worked at the Bay Point Marriott Golf Resort & Spa, 4200 Marriott Drive, Panama City Beach, Florida 32408 USA (Phone: 1-850-236-6000), were being housed by a labor contractor who rented 2-3 of 4 Waterstone Resort Realty condo units at the Nautilus Cove Condo. This was ongoing violation of many condo documents and had been going on since 8/2007 and the matter remains before the Circuit Court in Panama City. Waterstone has since had all 4 of their Nautilus Cove condos foreclosed by Compass Bank and 3 have since been sold to new owners. While the violations are now over, the matter needlessly continues in court.

Van transporting Marriott employees

March 21, 2008 2 Orientals leave from condo 716 (over my own condo) and Black female leaves from 712.

On March 29, 2008 I observed several women workers get into White Ford van Fla Plate G96 4DA with the #3 on the back cargo door panel and followed it while it was driven to Marriott Hotel and Resort in PCB, where the women got out and went into a building via a door next to the loading bay. The women who resided in the Waterstone condos went back and forth to work in this and another van.

Labor contractors have Marriott contracts

In a phone call with the Manager of the Marriott I was told that three Labor Contractors have contracts with Marriott. They bring workers to the US to work at various firms, arrange their paperwork, visa's and travel. Obviously they also arrange 'housing' for them, which in the case of the Mariott workers is at Nautilus Cove Condos and is completely against the condo regulations which Waterstone Realty agreed to abide by when they purchased 4 units here:

Going to work at the Marriott-

Employees going to work at Bay Point Marriott Golf Resort and Spa, at 4200 Marriott Drive, in Panama City Beach, Fla. 7:30 a.m.






























Workers are picked up and returned in a white Ford van (G964DA Fla) driven by the below labor contractor employee, who has keys to the 2 rented units, he picks up and drops off linen for the apartments and also picks up new workers at the airport.

The usual parade of maids leaving for work at the Marriott. Some days it is 5 some days it is 9-10.
